1. What information do we collect?

Personal information you disclose to us. We collect personal information that you voluntarily provide to us when you register on the Services, express interest in our products, participate in activities on the Services, or otherwise contact us. Depending on how you interact with us, this may include:

We do not process sensitive information. Payment Data: we may collect data necessary to process your payment, such as your payment instrument number and associated security code. All payment data is handled and stored by Stripe — see stripe.com/privacy.

Information automatically collected. Some information — such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, and location — is collected automatically when you visit our Services. This is primarily needed to maintain security and operation of the Services and for internal analytics and reporting.

We process your personal information for a variety of reasons depending on how you interact with our Services, including: to facilitate account creation and authentication; to deliver and facilitate delivery of the Services you request; to respond to your inquiries and offer support; to send administrative information about our products, services, and changes to our terms and policies; to fulfill and manage your orders, payments, returns, and exchanges; and to protect an individual’s vital interests, such as to prevent harm.

3. What legal bases do we rely on to process your information?

We only process your personal information when we have a valid legal reason to do so under applicable law — such as your consent, to comply with legal obligations, to perform a contract with you, or to protect vital interests. If you are located in the EU or UK, we rely on consent, performance of a contract, legal obligations, and vital interests as applicable. If you are located in Canada, we may rely on express or implied consent, or on exceptions permitted under applicable law such as fraud detection, business transactions, or compliance with a court order.

We may share your data with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf, including cloud computing services, payment processors, data analytics services, data storage providers, and user account registration and authentication services. We may also share or transfer information in connection with a merger, sale of company assets, financing, or acquisition of all or part of our business.

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services, to maintain security, prevent crashes, fix bugs, save preferences, and assist with basic site functions. We also permit third parties and service providers to use tracking technologies for analytics and advertising. We may share your information with Google Analytics to track and analyze use of the Services — you can opt out at tools.google.com/dlpage/gaoptout.

6. How long do we keep your information?

We keep your personal information for as long as necessary to fulfill the purposes outlined in this notice, unless a longer retention period is required by law. No purpose in this notice requires us to keep your personal information for longer than three (3) months past the termination of your account. When there is no ongoing legitimate business need, we will delete or anonymize your information, or securely isolate it if deletion is not immediately possible.

7. How do we keep your information safe?

We have implemented appropriate technical and organizational security measures designed to protect your personal information. However, no electronic transmission or storage technology can be guaranteed 100% secure, so we cannot promise that unauthorized third parties will never be able to defeat our security. Transmission of personal information to and from our Services is at your own risk.

8. Do we collect information from minors?

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor knowingly sell such personal information. If we learn that personal information from a user under 18 has been collected, we will deactivate the account and take reasonable measures to delete such data. 9. What are your privacy rights?

Depending on your region — including the EEA, UK, Switzerland, and Canada — you may have the right to request access to and a copy of your personal information, request rectification or erasure, restrict processing, request data portability, and object to processing, including automated decision-making. You may withdraw consent at any time, and unsubscribe from marketing communications via the link in our emails or by replying STOP/UNSUBSCRIBE to our texts. You can review or update your account information by logging in to your account settings, or request termination of your account by contacting us.

10. Controls for Do-Not-Track features

Most browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature. As no uniform technology standard for recognizing and implementing DNT signals has been finalized, we do not currently respond to DNT signals. If a standard is adopted that we must follow, we will inform you in a revised version of this notice.

11. Do United States residents have specific privacy rights?

If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Montana, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia, you may have the right to know, access, correct, and delete your personal information, obtain a copy of it, and opt out of certain processing including targeted advertising, sale of personal data, or profiling. We have not sold or shared personal information to third parties for a business or commercial purpose in the preceding twelve months. To exercise these rights, visit fetcha.io/data-request or email legal@fetcha.io; you may designate an authorized agent to submit a request on your behalf, subject to identity verification. If we decline to act on your request, you may appeal by emailing legal@fetcha.io, and if denied, submit a complaint to your state attorney general. California residents may also invoke the "Shine the Light" law (Civil Code Section 1798.83) once per year, free of charge.

12. Do other regions have specific privacy rights?

Australia and New Zealand. We collect and process your personal information under the obligations and conditions of Australia’s Privacy Act 1988 and New Zealand’s Privacy Act 2020. You may request access to or correction of your personal information at any time, and lodge a complaint with the Office of the Australian Information Commissioner or the Office of the New Zealand Privacy Commissioner if you believe we are unlawfully processing your information.

Republic of South Africa. You have the right to request access to or correction of your personal information at any time. If unsatisfied with how we address a complaint, you may contact the Information Regulator of South Africa.

13. Do we make updates to this notice?

Yes, we will update this notice as necessary to stay compliant with relevant laws. The updated version will be indicated by a revised "Last updated" date, and where changes are material we may notify you by prominently posting a notice or sending a direct notification.

14. How can you review, update, or delete the data we collect from you?

Based on the applicable laws of your country or state of residence, you may have the right to request access to the personal information we collect from you, details about how we have processed it, correction of inaccuracies, or deletion of your personal information, and you may withdraw your consent to our processing at any time.
